'Phony pony' bandit to drop excessive force lawsuit against Snohomish County

SNOHOMISH COUNTY, Wash. — The man known as the “Phony pony bandit” has dropped a $6 million lawsuit against Snohomish County.

Police say Todd Kirkpatrick got the name from his 2012 crime spree where he would wear the same wig during robberies.

After robbing a Key Bank in Stanwood, he waved a gun at a police officer. The officer shot him.

KIRO 7 talked to Snohomish County prosecutors two years ago when Kirkpatrick filed a lawsuit accusing police of using excessive force.

“We believe this lawsuit to be completely frivolous. We look forward to defending it in court and having the matter thrown out,” said Jason Cummings with the Snohomish County Prosecutor's Office.

The Everett Herald reports that Kirkpatrick supported a request to drop the lawsuit.
