ST. AUGUSTINE, Fla. — The mother of a 13-year-old boy accused of murder was arrested Saturday for tampering with evidence, investigators said.
Crystal Smith turned herself in before noon on Saturday, WJAX reported.
According to the arrest warrant, Smith, the mother of Aiden Fucci, was wanted for washing the jeans he wore when he allegedly killed 13-year-old Tristyn Bailey. Fucci was charged with first-degree premeditated murder. He was initially charged with second-degree murder. Because Aiden is a juvenile he will not face the death penalty; however, he does face life in prison. He is being held without bond.
Investigators said Smith was present when Fucci was interviewed by authorities about Bailey’s death. After Fucci left with deputies, Smith is seen on home surveillance video going into his room, removing a pair of jeans then washing them in a bathroom sink. A couple hours later she returned the jeans to his room. Investigators later found the jeans in his room. They tested positive for blood residue.

State Attorney R.J. Larizza said, “Tampering with evidence is tampering with justice and cannot be excused or tolerated.”
Sheriff Rob Hardwick said, “I remain incredibly proud of the men and women of the St. Johns County Sheriff’s Office for their continued thoroughness in this investigation. Our goal in any investigation is to ensure proper accountability across the board for successful prosecution.”
“Crystal Smith will be held responsible for her role in this case and justice will be served for Tristyn Bailey and her family.”
Smith was released from jail on $25,000 bond, according to jail records.
